Reporting and Redress procedures

We offer the possibility to report items or other content that you believe are not in compliance with applicable laws or our Terms of Use ("Report") via the "Report Legal Concerns" link on the respective product page on our Marketplace. This reporting option is limited to the following content/offences: (i) infringement of intellectual property rights, (ii) incorrect or missing information about products or Merchants, (iii) inappropriate content, (iv) non-compliance with ABOUT YOU Terms of Use or policies, (v) any other violation of rights. We will review your reports and inform you of the outcome of our review, including any action taken. The users concerned will also be informed if we take action as a result of the report.

The reporting person or organization and affected users registered in the European Union can appeal free of charge against decisions (and in the case of the reporting person or organization also in the case of omission) by ABOUT YOU resulting from a report described above. However, this right of appeal only applies to decisions (or omissions) in connection with unlawful content or violations of the DSA. In addition, the right of appeal is limited to the following measures by ABOUT YOU: (i) the removal of certain content, the blocking of access to it or the restriction of its display, (ii) the complete or partial restriction or deletion of an ABOUT YOU account or access to ABOUT YOU due to certain content, or (iii) the suspension or termination of payments in connection with content provided by a user or any other restriction on the user's monetization of certain content.

Dispute Resolution

There is also the right to out-of-court dispute resolution in relation to the above measures of ABOUT YOU as well as in relation to complaints that have not been resolved through ABOUT YOU's complaint management system. For this purpose, an out-of-court dispute resolution body certified and competent under the Digital Services Act can be elected. The European Commission has published a list of the out-of-court dispute resolution bodies. The right to take legal action before ordinary courts in accordance with applicable laws for disputing the decisions or actions of ABOUT YOU remains unaffected.
