Conditions of participation in the “ABOUT YOU Shoppery” raffle 1. Organizer
The organizer of the “ABOUT YOU Shoppery” raffle is ABOUT YOU SE & Co. KG, represented by ABOUT YOU Verwaltungs SE, which is represented by the Management Board Tarek Müller, Hannes Wiese and Sebastian Betz, Domstraße 10, 20095 Hamburg (hereinafter: “ABOUT YOU” and/or “organizer” and/or “we”).
2. Participation
Any natural person over the age of 18 and resident in the Federal Republic of Germany, Austria, Switzerland, Czech Republic, Slovakia, Romania, Hungary, Poland is eligible to participate. This excludes employees of ABOUT YOU, its cooperation partners and third-party companies involved in the realization of the raffle, as well as their respective family and household members. Participation in the raffle requires an order from ABOUT YOU during the promotion period.
Free participation in the raffle is also possible by sending a postcard with your first and last name, your telephone number, your email address and your address to the following address: ABOUT YOU SE & Co. KG, Domstr. 10, 20095 Hamburg, Germany. The postmark must be legible and within the campaign period. For one postcard you will receive one chance of winning (virtual chance).
3. It's that simple!
Here's what you need to do to take part:
Order and participate automatically: With every order placed during the promotion period (20.09.2024 10:00 to 29.09.2024 23:59) via our web stores or our apps in the Federal Republic of Germany, Austria, Switzerland, Czech Republic, Slovakia, Romania, Hungary or Poland, you automatically take part in the raffle.
Wait 100 days: After our standard returns period of 100 days, we will draw the 10 winners. You will receive one chance to win (i.e. one virtual ticket) for every euro of product order value. The value of ordered products that are returned will not be taken into account when determining the chance of winning.
Example:
Order in the amount of EUR 10.00 = 10 chances to win (10 x EUR 1)
Order of 10.00 EUR; complete return = 0 chances to win
Order in the amount of 10.00 EUR; partial return in the amount of 7.00 EUR = 3 chances to win (3x1 EUR)
Claim your prize: If you win, you will receive a winning notification email and must claim your prize within 10 days to claim it
Participation is possible from 20.09.2024 10:00 to 29.09.2024 23:59.
4. Closing date, number of possible entries
The raffle runs from 20.09.2024 10:00 to 29.09.2024 23:59 CET. Late entries, for whatever reason, will not be considered. Participation applies to every order placed during the promotion period.
5. prizes, draw and notification
We will raffle off the following prize among all participants in mid-January 2025:
10 x EUR 100,000.00 (in words: one hundred thousand euros).
The draw will not take place as a multiple draw. Therefore, a maximum of one prize per participant (1 x €100,000.00) is possible.
The winners will be notified by email in mid/end January 2025 via the email address provided in the customer account. If the winner does not claim his/her prize within 10 days of receiving notification of the prize, the claim to the prize will be forfeited. The prize can be claimed by replying to the corresponding prize notification by email.
6. Handover
The prize will be transferred by bank transfer to the account specified by the winner after the winner has been checked. The transfer will be made in euros. The transfer requires the winner to provide their full name, home address, date of birth and bank details. Otherwise it will not be possible to hand over the prize. The data provided will be used exclusively for the one-off verification of the winner and for the handover of the prize and will not be used for any other raffle purposes thereafter. This does not affect the Organizer's obligation to retain data in accordance with applicable commercial and/or tax law. Costs incurred in connection with the redemption/use of the prize are not covered by the prize. The winner is solely and exclusively responsible for tax matters.
7. Cash payment/exchange/assignment
An exchange and/or assignment of the prize or a cash payment is not possible.
8. termination of the raffle
The organizer has the right to change the raffle period at any time and without prior notice or to terminate the raffle without notice, e.g. if the functionality of the organizer's systems should be restricted for technical or other reasons independent of the organizer, or if the suspicion should arise that a participant is attempting to influence the results of the raffle.
9. Exclusion from participation
Participation via automated procedures or other manipulations or such attempts (including by third parties) is not permitted, nor is a breach of the conditions of participation or an attempt to do so. In the aforementioned cases or in the event of suspicion to this effect, the organizer has the right, for example, to exclude participants from the raffle, to subsequently deny or reclaim prizes.
10. Liability
The Organizer shall not be liable for any direct, indirect or special losses and/or damages incurred by participants as a result of their participation and associated with a disruption in the communication or power lines, outages at the mobile network operators, the effects of harmful software, unfair acts by third parties aimed at unauthorized access and/or the disabling of the Organizer's software and/or hardware, or force majeure circumstances. In such cases, the organizer is not obliged to reimburse any losses incurred by the participants.
The organizer is liable to the participant for culpably caused damages resulting from injury to life, body or health, for damages caused intentionally or through gross negligence by the organizer, the legal representatives or vicarious agents of the organizer, as well as for damages resulting from a breach of a guarantee given to the participant without limitation in accordance with the statutory provisions.
Otherwise, the organizer shall only be liable for the slightly negligent breach of obligations, the fulfillment of which is essential for the proper execution of the campaign and on the observance of which the participant may regularly rely (cardinal obligations), limited to the foreseeable damage typical for the contract. The above limitation of liability applies accordingly to the personal liability of the organizer's legal representatives and vicarious agents.
11. data protection
The organizer uses the data provided by participants in accordance with the provisions of German and European data protection law.
Your rights
In addition to the right to revoke consent given to us, you have the following additional rights if the respective legal requirements are met:
the right to information about your personal data stored by us (Art. 15 GDPR);
the right to rectification of inaccurate data or completion of correct data (Art. 16 GDPR)
the right to erasure of your data stored by us (Art. 17 GDPR), provided that no statutory or contractual retention periods or other statutory obligations or rights to further storage must be complied with

12. final provisions
German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the country in which the consumer has his habitual residence remain unaffected. Should individual provisions of these conditions of participation be ineffective or contradict the statutory regulations, the remaining conditions shall not be affected by this. In this case, the statutory provisions shall apply. The same applies to the closing of a contractual loophole. Legal recourse is excluded.
